What is Service of Process?

After retaining an attorney and filing a petition for divorce, the next step is to notify the non-filing spouse of the petition for divorce formally. Service of process is the legal process for notifying the non-filing spouse that a petition for divorce has been filed. 

What if my spouse does not want to be served and attempts to serve my spouse are unsuccessful? 

There are situations where the sheriff or process server will be unable to locate the non-filing spouse for service. This scenario is common; often, the non-filing spouse will be aware of an impending divorce and will attempt to avoid it for as long as possible. 

In this situation, you will be able to file a “special motion” with the court. You will then be able to obtain special permission from the court to serve the spouse through other means. The judge will provide you with the ability to serve the non-filing spouse through certified mail or even through public notice in the newspaper. Upon approval, the judge will issue the order instructing the non-filing spouse through what additional means service may occur.  

If your spouse does not file an answer after being properly served, a default judgment can be entered after the 60th day after the petition was filed.   

¿Qué es la notificación del procedimiento? ¿Qué ocurre si mi esposo no quiere ser notificado?  

Después de ocupar los servicios de un abogado y entablar la demanda de divorcio, el siguiente paso es la notificación formal a su cónyuge; a este proceso legal se le llama notificación del procedimiento. 

¿Qué ocurre si mi esposo no quiere ser notificado y los intentos de entregarle la notificación fracasan? 

Hay situaciones donde el alguacil o el notificador de tramite no encuentran al cónyuge para notificarle del divorcio.  Esto es muy común; muchas veces el cónyuge sabe que el divorcio es inevitable y tratan de prolongarlo lo más posible.   

En este caso, usted puede entablar una moción especial con la corte.  Usted tendrá la oportunidad de obtener permiso especial para notificar a su esposo de otras maneras.  El juez le dará la opción de notificar a su esposo por correo certificado o hasta por publicación en el periódico.  Una vez aprobado, el juez emitirá una orden con instrucciones de cómo llevar a cabo la notificación.  

Si su esposo no contesta la demanda después de ser debidamente notificado y una vez que hayan pasado 60 días, usted puede solicitar que la corte emita un fallo por falta de comparecencia.
