Divorce – Social Media Use and Family Law

When information about personal lives is shared on social media or any other form of public platforms, it becomes part of the public network, especially when shared online. If you are contemplating divorce, it’s important to keep in mind what you (and your spouse) say and do on social media (post, repost, tweet, like, comment, friend, follow, share) can be used to help or hurt you in a divorce or custody case. It is virtually impossible to know with absolute certainty who might take a screenshot of a posted photo or comment, making it available long after the post has been deleted or removed. No matter how strictly you manage privacy and access to your social media pages, it’s still possible for someone to screenshot, save, and share the information.

Always be SMART when posting to any social media.

If it’s out there, opposing counsel will usually find it. If your friends can see it, they can share it with your ex. As your attorney, you can bet that we will be looking at the social media for our clients and the opposition.

During the stressful process of divorce or custody cases, it’s common for people to make snap decisions to post photos, statuses, or comments that they later regret. For example, posting pictures of a new significant other or pictures of new purchases like a vehicle, expensive jewelry, or a lavish vacation can quickly escalate an amicable situation to a contentious and disagreeable proceeding. A good rule of thumb is to not share anything you wouldn’t want a judge to see on a PowerPoint presentation in the courtroom.

Cuando información acerca de vidas personales se comparte en redes sociales esta se hace parte de las redes públicas.  Si usted está pensando en el divorcio, es importante tener en cuenta que lo que usted y su pareja digan o hagan en una red social, ya sea exponer, tuitear, comentar, seguir, o compartir, pueden ser usados para su beneficio o para afectarle en un procedimiento de divorcio o custodia.  Es virtualmente imposible saber con absoluta certeza quien guardó una imagen de una foto o un comentario, lo cual significa que sigue disponible para usarse mucho tiempo después de que se borró.  No importa que tan estrictamente maneje su privacidad y acceso a las páginas de las redes sociales, es posible que alguien guarde, baje o comparta la información.   

Si está contemplando el divorcio, o su caso de divorcio o custodia ya está en proceso, es crítico pensar y ser precavido cuando decide compartir cosas en las redes sociales.  Si existe algo, puede estar seguro que el abogado opuesto lo encontrará.  Un divorcio o custodia son procesos de estrés y es común que la gente haga cosas sin pensar y comparten fotos o comentarios de los cuales después se arrepienten.  Por ejemplo, subir fotos con otra persona o fotos de compras nuevas tal como un vehículo, joyas, o unas vacaciones, pueden escalar lo que antes era una situación amigable a un procedimiento polémico y desagradable.  Un buen consejo es no compartir nada que usted no quiera que el juez vea.
