When you walk into a family law courtroom, the stakes are measured not in dollars and cents, but in the daily right to raise your child. For parents navigating high-stakes custody battles, understanding parental rights protections in Texas is essential when trial courts make fundamental errors and appellate strategy becomes your ultimate safeguard. As a practicing family law attorney and host of the Texas Lawyer Podcast, I have seen firsthand how deeply personal and emotionally intense custody litigation can be. Parents come to my office carrying the heavy burden of fear. They fear that legal technicalities, unforeseen tragedies, or rulings that fail to recognize their fundamental constitutional rights could fracture their relationship with their children.
Protecting Your Family: Appellate Strategy and Landmark Parental Rights Victories in Texas
Most people assume that family law is fought and won entirely at the trial court level. We picture closing arguments, witness testimonies, and judges rendering decisions from the bench. But what happens when a trial court gets it fundamentally wrong? What happens when a routine case unexpectedly intersects with constitutional law and shapes the legal landscape for millions of families across the Lone Star State?
In a recent episode of the Texas Lawyer Podcast, I sat down with premier family law attorney and appellate strategist Holly Draper, founder of Draper Law Firm in the Dallas-Fort Worth area. Holly knows better than anyone what it takes to fight for parents when everything is on the line. Beyond managing a thriving practice, Holly is the powerhouse litigator who took on two high-stakes constitutional battles and secured unanimous 9-0 victories at the Texas Supreme Court in In re C.J.C. and Starr v. Ethridge.
If you are a parent facing a complex custody battle, a post-judgment modification, or an appeal, understanding these landmark victories—and why appellate strategy matters—is essential to protecting your parental rights.
The Reality of High-Stakes Custody Litigation
Family law is rarely static. Life changes, relocations happen, and tragic circumstances sometimes upend even the most stable co-parenting arrangements. When disputes arise, parents often enter the legal system believing that common sense and their status as a fit, loving parent will automatically carry the day.
Unfortunately, the law is complex, and statutory interpretations can vary wildly from one courtroom to another. Trial courts must make rapid decisions under immense pressure, and occasionally, judicial overreach occurs. When a trial court infringes on a fit parent’s constitutionally protected rights, the fight shifts from the trial docket to the appellate court.
This is where specialized appellate strategy becomes the ultimate safeguard for families. An appeal is not simply a retrial of the facts; it is a rigorous, highly intellectual examination of the law, constitutional protections, and judicial procedure. Having an attorney who knows how to navigate the appellate courts can mean the difference between losing your parental rights and establishing a historic precedent that protects them.
When a Routine Custody Modification Turns into a Constitutional Battle: In re C.J.C.
To understand the immense impact of specialized appellate work, you have to look at how cases evolve. When In re C.J.C. first landed on Holly Draper’s desk, it looked like a fairly standard, albeit difficult, family law matter.
The case began as a routine custody modification between a mother and father who shared a nearly 50-50 arrangement. The mother wanted the father to have less time and pay more in financial support. For a time, the litigation hovered in familiar territory. But then, unthinkable tragedy struck: the mother was tragically killed in a car accident, leaving behind a three-year-old child.
In the wake of such a tragedy, the legal landscape shifted overnight. First, the maternal grandparents filed a lawsuit seeking custody and access. Holly immediately recognized that, under Texas law, the grandparents lacked legal standing to bypass a fit father’s constitutional rights, and she successfully filed a mandamus action to remove them.
However, the legal battle was far from over. As soon as the grandparents were struck from the case, the mother’s live-in boyfriend—who had recently become her fiancé—filed an intervention seeking custody of the child.
In a shocking temporary orders hearing, the trial court granted the non-parent fiancé rights and possession of the child, directly overriding the objections of a completely fit, loving biological father.
This ruling represented a profound threat to parental rights. Under the United States Constitution and Texas family law, fit parents have a fundamental, constitutionally protected right to make decisions regarding the care, custody, and control of their children. A trial court can’t simply hand custody or visitation rights over to a non-parent over a fit parent’s objection just because the court believes it might be in the child’s best interest.
Recognizing the gravity of the injustice, Holly took the fight to the next level, filing a mandamus action that ultimately landed in the Texas Supreme Court.
The stakes could not have been higher. A loss would have set a dangerous precedent, opening the door for third parties, romantic partners, and extended family members to chip away at fit parents’ fundamental rights across Texas. But precision, dedication, and deep constitutional scholarship prevailed. The Texas Supreme Court ruled unanimously in In re C.J.C., issuing a landmark 9-0 decision that reinforced the bedrock protections of parental rights and clarified the strict legal standards required before a court can interfere with a fit parent.
Continuing the Fight: Starr v. Ethridge
Proving that lightning can indeed strike twice when backed by exceptional legal expertise, Holly secured a second monumental victory at the Texas Supreme Court in Starr v. Ethridge.
Arising from a 2024 trial and resulting in a 2025 opinion, Starr v. Ethridge was another high-stakes constitutional parental rights case. Holly stepped up to defend the sacred bond between fit parents and their children against unwarranted judicial infringement. And once again, the Texas Supreme Court delivered a decisive, unanimous 9-0 ruling in favor of parental rights.
Securing back-to-back 9-0 victories at the Texas Supreme Court is an extraordinary achievement that very few attorneys in the state can claim. It requires encyclopedic knowledge of family code statutes, mastery of constitutional jurisprudence, exceptional appellate brief-writing skills, and the fearlessness to stand before Texas’s highest judges and defend families’ rights.
Why Choosing the Right Attorney Matters When Your Family Is on the Line
When you are facing a high-conflict divorce, a contentious child custody dispute, or a complex post-judgment appeal, you can’t afford to leave your family’s future to chance. Not all law firms are equipped to handle the rigorous demands of advanced litigation and appellate strategy.
The best legal advocates combine tireless courtroom grit with intellectual rigor. They understand the emotional weight their clients carry and have the strategic vision to look beyond the immediate trial-court horizon and protect their clients’ long-term interests.
Whether you are seeking to establish a fair custody arrangement, defend your rights against non-parent interference, or challenge an improper trial court ruling on appeal, you need an attorney who commands the courtroom and masters the law.
