The Reality of Deposition Anxiety
Facing a deposition in a high-conflict divorce or child custody dispute is often one of the most nerve-wracking experiences of a person’s life. Sitting across the table from opposing counsel, and often an abusive or hostile ex-spouse, can trigger overwhelming anxiety, causing even the most prepared individuals to freeze or misstate crucial facts.
At McGirr Law, we recognize that testifying effectively isn’t about putting on a flawless performance; it’s about mastering your anxiety and telling your truth clearly. In a recent episode of the Texas Lawyer Podcast, I sat down with legendary jury consultant and witness preparation expert Robert Swafford to discuss actionable strategies for turning testimony anxiety into a tactical advantage.
Here are the core principles and counter-intuitive methods to help you overcome “deposition dread” and testify with confidence.
Normalizing Courtroom Nerves
One of the biggest misconceptions clients have is that they must completely eliminate their nervousness before testifying. As Robert Swafford explains, unless someone is a stone-cold sociopath, being nervous during litigation is completely natural and expected.
The goal is not to kill the “butterflies in your stomach”—it is to get them to fly in formation. A healthy degree of nervous energy keeps your mind sharp, focused, and attuned to the questions being asked. The real danger isn’t being nervous; it’s the massive mental energy consumed when you try to pretend you aren’t nervous. Pretending drains your cognitive bandwidth, making it harder to recall details or process questions accurately.
The Power of Radical Honesty: Acknowledge Your Nerves
When asked “How are you today?” at the start of a deposition or direct examination, most people reflexively answer “I’m fine.” However, framing your true state of mind offers immediate relief and tactical leverage.
By answering truthfully—“I’m a little nervous, but I’m ready to get through it”—you instantly unlock mental bandwidth. Admitting your nerves frees your cortex to concentrate strictly on the questioning. Furthermore, in front of a judge or jury, stating your nervousness creates immediate empathy and credibility.
The “Batter at the Plate” Mental Framework
Hostile opposing attorneys often attempt to set traps by asking rapid-fire, leading, or emotionally charged questions. Nervous witnesses frequently fall into the trap of trying to guess where opposing counsel is heading, leading to panicked responses or defensive tangents.
Swafford recommends approaching a deposition like a batter standing at home plate:
- Watch one pitch at a time: Focus solely on the specific question being thrown at you.
- Swing only at that pitch: Answer only the exact question asked without anticipating the next three moves or explaining background minutia.
- Reset for the next pitch: Once your response is complete, pause and wait for the next question. Eventually, the opposing side will run out of pitches.
In Closing
Depositions in family law cases can feel overwhelming, but you do not have to navigate them alone. With structured preparation, tactical tools, and compassionate advocacy, you can turn deposition dread into clarity and leverage.
